Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. In face of the multiple controversies surrounding the DSM process in general and the development of DSM-5 in particular, we have organized a discussion around what we consider six essential questions in further work on the DSM. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM – whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part 1 of this article took up the first two questions. Part 2 took up the second two questions. Part 3 now deals with Questions 5 & 6. Question 5 confronts the issue of utility, whether the manual design of DSM-III and IV favors clinicians or researchers, and what that means for DSM-5. Our final question, Question 6, takes up a concluding issue, whether the acknowledged problems with the earlier DSMs warrants a significant overhaul of DSM-5 and future manuals. Pancreatitis is a complex, progressively destructive inflammatory disorder. Alcohol was long thought to be the primary causative agent, but genetic contributions have been of interest since the discovery that rare PRSS1, CFTR and SPINK1 variants were associated with pancreatitis risk. We now report two associations at genome-wide significance identified and replicated at PRSS1-PRSS2 and X-linked CLDN2 through a two-stage genome-wide study. The PRSS1 variant likely affects disease susceptibility by altering expression of the primary trypsinogen gene. The CLDN2 risk allele is (...) associated with atypical localization of claudin-2 in pancreatic acinar cells. The homozygous CLDN2 genotype confers the greatest risk, and its alleles interact with alcohol consumption to amplify risk. In the conclusion to this multi-part article I first review the discussions carried out around the six essential questions in psychiatric diagnosis – the position taken by Allen Frances on each question, the commentaries on the respective question along with Frances’ responses to the commentaries, and my own view of the multiple discussions. In this review I emphasize that the core question is the first – what is the nature of psychiatric illness – and that in some manner all further (...) questions follow from the first. Following this review I attempt to move the discussion forward, addressing the first question from the perspectives of natural kind analysis and complexity analysis. His theological output even prior to becoming pope (...) is staggering. It is thus fitting that an edited volume examine his theological oeuvre; there is a need for many more such volumes. The essays collected in this book were originally presented at a conference on the theology of Pope Benedict at the University of Notre Dame. Each contribution brings something insightful and unique to the volume. The book is divided into three sections: “The Dynamic of Advent,” encompassing chapters 2–5; “Caritas in Veritate,” encompassing chapters 6–7; and “God is Love,” encompassing the remaining chapters 8–11. The initial chapter-length introduction and the first chapter fall outside of this division because in many ways they set the stage for the entire volume.John Cavadini’s introduction (1–20) could serve as a useful overview of the theological work of Pope Benedict. Cavadini provides a preview of each chapter but also underscores the significance of Benedict’s theological work. He emphasizes how “one of Benedict’s major achievements is the demonstration of Augustine’s original insight into the unity of the theological tasks of understanding and of engendering understanding” (3).Cyril O’Regan’s very fine essay, “Benedict the Augustinian” (21–60), examines the Augustinian nature of Benedict’s theology. O’Regan maintains, “throughout his career Benedict not only turns again and again to Augustine as his theological model, but also... in Benedict’s self-understanding[,] the basic figuration of his theology is Augustinian” (22). This Augustinian texture to Benedict’s theology involves, among other things, his “real familiarity with and admiration” for “the classic” works of Augustine, his use of Augustine’s “theological style,” his use of shared themes, and the manner in which he consciously “articulates substantive theological positions” typical of Augustine. Moreover, O’Regan points to “Benedict’s sense that he is living in a time of crisis and senescence similar to that of Augustine” (21–22). Some of the similarities O’Regan observes in the theological work of Augustine and Benedict pertain to eschatology, the relationship between faith and reason, biblical interpretation, culture, the role of the liturgy, and the centrality of prayer. O’Regan’s essay is undoubtedly the best piece I have read on the importance of Augustine for Benedict.The thesis of Peter Casarella’s “Culture and Conscience in the Thought of Joseph Ratzinger/Pope Benedict XVI” (63–86) is that for Benedict, “the witness to truth is the key to seeing how culture and conscience are necessarily intertwined” (64). Casarella initiates his investigation with the pope’s critique of relativism. The first major section examines what he terms Benedict’s “theology of culture.” For Benedict, this has a moral dimension, and thus [End Page 493] Caserella spends the entire second portion of his essay looking at conscience and its formation in the context of culture. This is a very helpful essay that makes an important contribution to Benedict’s thought as it relates to moral theology.The late Fr. Edward Oakes’s contribution, “Resolving the Relativity Paradox: Pope Benedict XVI and the Challenge of Christological Relativism” (87–113), explores Benedict’s problem with relativism, but homes in on relativism in the context of Christology. Oakes argues, “the challenge of relativism cannot be met unless it is done first and foremost in Christological terms” (93), and he thinks Benedict does precisely this. Oakes’s overview of Ernst Troeltsch’s discussion of historical criticism as corrosive to Christology is enlightening:what most undermines Christocentrism is the historical-critical method, not so much because of the results arising from that method as from its very use.... Since its more or less formal beginning in the sixteenth century as a reconstruction of ancient drama, opera as an art form has been controversial. The received understanding—emphasized by the genre's founders and in periodic efforts at reforming the standards of composition and production—is that opera is musical drama. In his book Opera (...) as Drama, Joseph Kerman reasserted this view as an antidote to what he called "flabby relativism" and in order to be able to determine a set of values that could serve as a basis for opera criticism.1 He argues that while opera is "excellently its own art form," it is one where the story serves as the central framework in terms of which the particularities of the words and music are structured.2 Given a story, the librettist and the composer work to express the narrative dramatically, using words and music to convey not only the events of the story but the emotions bound up in the story. For Kerman, in a successful opera the words express the narrative and the music enriches it by providing the emotional aspect. One can then evaluate an opera in light of the drama expressed in the relation of the narrative to the words and music. Disconnection between the words and music undermine the value of the opera, even if the words adequately express the narrative and the music adequately expresses some emotion.Philosopher Bernard Williams, in his collection On Opera, affirms Kerman's general conception of opera and adds to it two important factors. First, while the words and music are essential to the drama presented, operas are also distinct in that they are staged and not concert pieces. In this case, the details of the staging also contribute to the success of a particular opera (though the variation in staging usually falls out of discussions by [End Page 74] Kerman and Williams of particular operas). Second, Williams makes clear what is implicit in Kerman: "It is a fallacy to argue," Williams says, "that since, in a musical drama, music obviously provides the music, so the words must provide the drama."3 The drama is a product of both the words and the music in relation to the narrative whose meaning provides the frame on which these hang. Opera criticism, from this perspective, focuses on the specific ways in which the text of a given opera expresses or fails to express the drama of the story. Here, the words, since they present the story, are taken as primary. Williams quoted Calzabigi, a librettist and reformer associated with Gluck: "The music has no other function than to express what arises from the words, which are therefore neither smothered by notes nor used to lengthen the spectacle unduly, because it is ridiculous to prolong the sentence 'I love you' (for instance) with a hundred notes when nature has restricted it to three."4In contrast to Kerman's view of opera as drama, philosopher Peter Kivy, in his book Osmin's Rage, proposes a view of opera as music. Despite Kivy's claim that this notion serves as a more or less equivalent alternative to Kerman's, in fact it radically reorganizes how one thinks about opera and how one evaluates particular operas. Kivy's alternative is in part the result of a reading of the history of opera as an art form that began, in effect, as the answer to a philosophical problem: the relation of emotions to dramatic texts. The founders of opera, the Florentine Camerata, asked how, given a particular story—Antigone, Oedipus, or Orpheus, for example—does telling the story express the emotions that are central to the meaning of the story? How does telling the story go from "just the facts" to the felt meaning of tragedy? The answer for the Florentine Camerata was found in their understanding of ancient Greek tragedies, where they concluded that the problem was solved by singing the words. It does not ignore obvious differences... for to do so would be of no use for ·either friendship or truth." 3 A Muslim scholar, Professor Mohammed Taibi of the University of Tunis, likewise remarks that " the more one is firm about the classical aspects of divergence, the better the contacts between Christians and Muslims." 4 At issue in the Christian-Muslim discussion of the Incarnation is the unique character of each faith. In Islam, there is the absolute affirmation of divine unity (tawhid) which necessarily condemns any attempt to associate something other than God with God (shirk). Christianity, though, has as one of its central tenets the affirmation that the uncreated Word of God (ho logos) became flesh (sarx) in Jesus (John 1 :14). Islam, therefore, presents a unique challenge to the Christian theologian. Is it possible to formulate a Christology which can affirm the Islamic principle of tawhid and evade the accusation of shirk without compromising the core of the Christian message? This is the question this article hopes to address. One suggestion for Christians in dialogue with Muslims is given by Hans Kiing in his book Christianity and the World Religions.5 Kiing believes that Christians would do best to go back to the mindset of the original Jewish Christians who possessed an understanding of Jesus which is much more compatible with the Qur'anic view of Jesus as the "servant of God." 6 While Kiing's suggestion is helpful for Christians who are looking for an analogy to the Islamic view of Jesus, I find it problematical for several reasons. The most recent commentators on Edmund Burke have renewed the charge that his political thought lacks the consistency and coherency necessary to even claim the status of a political philosophy and that he is indeed a "utilitarian." They mark him off as an "ideologist," a "rhetorician," and a "deliberate propagandist." Even Burke’s Reflections on the Revolution in France, his most profound statement of a political philosophy, is regarded by some as a work of mere "persuasion," not "philosophy." All this occurs (...) in spite of the seminal work of Stanlis, Canavan, and Wilkins, who in the 1950s and ‘60s, demonstrated the natural law foundations of Burke’s politics. Burke revisionists, forced to acknowledge his use of the "natural law," label such use as a rhetorical means for utilitarian ends. Directly opposed to this renewed "utilitarian" interpretation of Burke is Joseph Pappin’s work The Metaphysics of Edmund Burke. Not only does this work challenge the "utilitarian" view of Burke, it sets out, as not other work on Burke has attempted to do, "to make explicit the implicit metaphysical core of Burke’s political thought." Pappin does this by examining both Burke’s critics and Burke’s own attack on a rationalist, ideologically inspired metaphysics. Drawing from Burke’s vast writings, Pappin establishes as his goal "to demonstrate that Burke’s political philosophy is grounded in a realist metaphysic, one that is basically consonant with the Aristotelian-Thomistic tradition." Does the author succeed? According to Francis Canavan, in his Foreword to this work, the "explanatory key" of a realist metaphysics grounding Burke’s politics "is a key that fits the lock better than any other that scholars have offered." In 1968, the Harvard criteria equated irreversible coma and apnea with human death and later, the Uniform Determination of Death Act was enacted permitting organ procurement from heart-beating donors. Since then, clinical studies have defined a spectrum of states of impaired consciousness in human beings: coma, akinetic mutism, minimally conscious state, vegetative state and brain death. In this article, we argue against the validity of the Harvard criteria for equating brain death with human death. Brain death does not disrupt somatic (...) integrative unity and coordinated biological functioning of a living organism. Neurological criteria of human death fail to determine the precise moment of an organism’s death when death is established by circulatory criterion in other states of impaired consciousness for organ procurement with non-heart-beating donation protocols. The criterion of circulatory arrest 75 s to 5 min is too short for irreversible cessation of whole brain functions and respiration controlled by the brain stem. Brain -based criteria for determining death with a beating heart exclude relevant anthropologic, psychosocial, cultural, and religious aspects of death and dying in society. Clinical guidelines for determining brain death are not consistently validated by the presence of irreversible brain stem ischemic injury or necrosis on autopsy; therefore, they do not completely exclude reversible loss of integrated neurological functions in donors. The questionable reliability and varying compliance with these guidelines among institutions amplify the risk of determining reversible states of impaired consciousness as irreversible brain death. The scientific uncertainty of defining and determining states of impaired consciousness including brain death have been neither disclosed to the general public nor broadly debated by the medical community or by legal and religious scholars. Heart-beating or non-heart-beating organ procurement from patients with impaired consciousness is de facto a concealed practice of physician-assisted death, and therefore, violates both criminal law and the central tenet of medicine not to do harm to patients. Society must decide if physician-assisted death is permissible and desirable to resolve the conflict about procuring organs from patients with impaired consciousness within the context of the perceived need to enhance the supply of transplantable organs. With the rise of analytical philosophy the criticism against Hegelianism has become increasingly shrill, and signs of an embarrassment that Hegel's philosophy should ever have arisen are noticeable in such inftuential works as those of Karl Popper and Hans Reichenbach, to mention but a few. However, many contemporary philosophers stress what is called subjectivity, conceiving reality as susceptible of methodical analysis only to the extent that it is in and for the subject. What is more, they not only insist on (...) the importance of the subject for philosophy, but maintain that the subject must be conceived as the principal determinative of true objectivity. Since knowledge depends for its possibility on the inseverable correlatives of consciousness and reality, they would grant that a proper importance must be given to both subject and object. Still, exemplifying the relational principle within the unity of a dual structure, the subject serves as an exclu sive agent that provides ingress into the meaning of the object. (shrink)

Since the introduction of the concept of brain death by the Ad Hoc Committee of the Harvard Medical School to Examine the Definition of Brain Death in 1968, the validity of this concept has been challenged by medical scientists, as well as by legal, philosophical, and religious scholars. In light of increased criticism of the concept of brain death, Stephen Napier, a staff ethicist at the National Catholic Bioethics Center, set out to prove that the whole-brain death criterion serves as (...) good evidence for death in the Catholic bioethical framework, on the grounds that when whole-brain death has occurred the soul has already departed from the body. Opponents have argued that (1) brain death does not disrupt the somatic integrative unity and coordinated biological functioning of a living organism and (2) clinical tests outlined in the practice guidelines for determining brain death lack sufficient power to exclude persisting function and fail to detect elements of the brain that, although currently functionless, may retain potential for recovery under conditions of optimal medical care. It is therefore possible that heart-beating organ procurement from patients with impaired consciousness is de facto a concealed practice of active euthanasia and physician-assisted death, both of which, either concealed or overt, the Catholic Church opposes. The tendency to test outcomes that are predicted by our current theory (the confirmation bias) is one of the best-known biases of human decision making. We prove that the confirmation bias is an optimal strategy for testing hypotheses when those hypotheses are deterministic, each making a single prediction about the next event in a sequence. Our proof applies for two normative standards commonly used for evaluating hypothesis testing: maximizing expected information gain and maximizing the probability of falsifying the current hypothesis. This analysis rests on two assumptions: (a) that people predict the next event in a sequence in a way that is consistent with Bayesian inference; and (b) when testing hypotheses, people test the hypothesis to which they assign highest posterior probability. We present four behavioral experiments that support these assumptions, showing that a simple Bayesian model can capture people's predictions about numerical sequences (Experiments 1 and 2), and that we can alter the hypotheses that people choose to test by manipulating the prior probability of those hypotheses (Experiments 3 and 4). Generalization is a fundamental problem solved by every cognitive system in essentially every domain. Although it is known that how people generalize varies in complex ways depending on the context or domain, it is an open question how people learn the appropriate way to generalize for a new context. To understand this capability, we cast the problem of learning how to generalize as a problem of learning the appropriate hypothesis space for generalization. We propose a normative mathematical framework for learning (...) how to generalize by learning inductive biases for which properties are relevant for generalization in a domain from the statistical structure of features and concepts observed in that domain. More formally, the framework predicts that an ideal learner should learn to generalize by either taking the weighted average of the results of generalizing according to each hypothesis space, with weights given by how well each hypothesis space fits the previously observed concepts, or by using the most likely hypothesis space. We compare the predictions of this framework to human generalization behavior with three experiments in one perceptual (rectangles) and two conceptual (animals and numbers) domains. Across all three studies we find support for the framework's predictions, including individual‐level support for averaging in the third study. (shrink)

Everyone has mistaken one thing for another, such as a stranger for an acquaintance. A person who has mistaken two things, Joseph Camp argues, even on a massive scale, is still capable of logical thought. In order to make that idea precise, one needs a logic of confused thought that is blind to the distinction between the objects that have been confused. Confused thought and language cannot be characterized as true or false even though reasoning conducted in such language (...) can be classified as valid or invalid. To the extent that philosophers have addressed this issue at all, they take it for granted that confusion is a kind of ambiguity. Camp rejects this notion; his fundamental claim is that confusion is not a mental state. To attribute confusion to someone is to take up a paternalistic stance in evaluating his reasoning. Camp proposes a novel characterization of confusion, and then demonstrates its fruitfulness with several applications in the history of philosophy and the history of science. (shrink)

In early 2017, Nevada amended its Uniform Determination of Death Act, in order to clarify the neurologic criteria for the determination of death. The amendments stipulate that a determination of death is a clinical decision that does not require familial consent and that the appropriate standard for determining neurologic death is the American Academy of Neurology’s guidelines. Once a physician makes such a determination of death, the Nevada amendments require the withdrawal of life-sustaining treatment within twenty-four hours with limited exceptions. (...) Neurologists have generally supported Nevada’s amendments for clarifying the diagnostic standard and limiting the ability of family members to challenge it. However, it is more appropriate to view the Nevada amendments with concern. Even though the primary purpose of the UDDA is to ensure that all functions of a person’s entire brain have ceased, the AAN guidelines do not accurately assess this. In addition, by characterizing the determination of death as solely a clinical decision, the Nevada legislature has improperly ignored the doctrine of informed consent, as well as the beliefs of particular faiths and cultures that reject brain death. Rather than resolving controversies regarding brain death determinations, the Nevada amendments may instead instigate numerous constitutional challenges. (shrink)
