Public health ethics, like the field of public health it addresses, traditionally has focused more on practice and particular cases than on theory, with the result that some concepts, methods, and boundaries remain largely undefined. This paper attempts to provide a rough conceptual map of the terrain of public health ethics. We begin by briefly defining public health and identifying general features of the field that are particularly relevant for a discussion of public health ethics.Public health is primarily concerned with (...) the health of the entire population, rather than the health of individuals. Its features include an emphasis on the promotion of health and the prevention of disease and disability; the collection and use of epidemiological data, population surveillance, and other forms of empirical quantitative assessment; a recognition of the multidimensional nature of the determinants of health; and a focus on the complex interactions of many factors—biological, behavioral, social, and environmental—in developing effective interventions. Nearly one year has passed since the release of the Committee’s final report and recommendations, and it seems an appropriate time to invite discourse and reflection on the influence and impact of the Committee and its (...) efforts. Our intent is to advance understanding of the Committee and its work, its place in the evolution of bioethics and public policy, as well as the broader legacy of restoring trust in the conduct of human subjects research.In 1993, President Clinton and Secretary of Energy Hazel O’Leary initiated an investigation of America’s involvement in radiation experiments on its citizens during the Cold War. The investigation resulted in the appointment of the Committee in January 1994. Some issues raised by these radiation experiments were brought to the attention of the nation by revelations contained in a Pulitzer Prize-winning series of newspaper stories about plutonium injections carried out by the government on allegedly unsuspecting subjects during the Cold War. The debate over the objects of episodic memory has for some time been stalled, with few alternatives to familiar forms of direct and indirect realism being advanced. This paper moves the debate forward by building on insights from the recent psychological literature on memory as a form of episodic hypothetical thought (or mental time travel) and the recent philosophical literature on relationalist and representationalist approaches to perception. The former suggests that an adequate account of the objects of episodic memory will (...) have to be a special case of an account of the objects of episodic hypothetical thought more generally. The latter suggests that an adequate account of the objects of episodic hypothetical thought will have to combine features of direct realism and representationalism. In this paper, we analyze the legal situation regarding physician-assisted suicide in the world. Our hypothesis is that the prohibitive stance on physician-assisted suicide in most societies in the world today seems to be related to our moral attitudes toward suicide. This brings us to a discussion about life itself. We claim that the total lack of legal protection for physician-assisted suicide from international organizations and most countries in the world lies in a philosophical assumption that supports much of our (...) common beliefs about what life really is. This assumption states that life must be thought of as not belonging exclusively to the individual. We argue that this assumption is a misconception that can be heard in the debate on suicide. Consequently we endorse a different conception of life which tends to favor a pro-choice stance towards suicide and assisted death in general. This position takes the patient’s decision about when to die more seriously. We conclude that there is no reason why physician-assisted suicide does not deserve legal protection as an individual right to die under international law. (shrink)

The first form of the inside-outside dichotomy appears as a self-encapsulated system with an active border. These systems are based on two complementary but asymmetric processes: constructive and interactive. The former physically constitute the system as a recursive network of component production, defining an inside. The maintenance of the constructive processes implies that the internal organization also constrains certain flows of matter and energy across the border of the system, generating interactive processes. These interactive processes ensure the maintenance of the (...) constructive processes thus specifying a meaningful outside. Upon this basic form of identity formation, the evolutionary and historical domain is open for the emergence of a whole hierarchy and ecology of insides and outsides. These which mutually subsume and collaborate in the maintenance of the essential inside-outside dichotomy that defines the conditions of possibility of the subjects and the worlds they generate. Recent research in philosophy of science has shown that scientists rely on a plurality of strategies to develop successful explanations of different types of phenomena. In the case of biology, most of these strategies go far beyond the traditional and reductionistic models of scientific explanation that have proven so successful in the fundamental sciences. Concretely, in the last two decades, philosophers of science have discovered the existence of at least two different types of scientific explanation at work in the biological (...) sciences, namely: mechanistic and structural explanations. Despite the growing evidence about the radically different nature of these two types of explanation, no inquiry has been conducted to date to determine the ontological reasons that might underlie these differences, nor the way in which these types of explanations can be systematically related with each other. Here, we aim to cover this gap by connecting this plurality of research strategies with the existence of emergent levels of reality. We argue that the existence of these different—and apparently incompatible—explanatory strategies to account for biological phenomena derives from the existence of “ontological jumps” in nature, which generate different regimes of causation that in turn demand the development of different explanatory frameworks. We identify two of these strategies—mechanistic modelling and network modelling—and connect them to the existence of two ontological regimes of causation. Finally, we relate them with each other in a systematic way. In this vein, our paper provides an ontological justification for the plurality of explanatory strategies that we see in the life sciences. (shrink)

Mental state reasoning or theory-of-mind has been the subject of a rich body of imaging research. Although such investigations routinely tap a common set of regions, the precise function of each area remains a contentious matter. With the help of functional magnetic resonance imaging (fMRI), we sought to determine which areas are involved when processing mental state or intentional metarepresentations by focusing on the relational aspect of such representations. Using non-intentional relational representations such as spatial relations between persons and between (...) objects as a contrast, the results ascertained the involvement of the precuneus, the temporal poles, and the medial prefrontal cortex in the processing of intentional representations. In contrast, the anterior superior temporal sulcus and the left temporo-parietal junction were implicated when processing representations that refer to the presence of persons in relational contexts in general. The right temporo-parietal junction, however, was specifically activated for persons entering spatial relations. The level of representational complexity, a previously unexplored factor, was also found to modulate the neural response in some brain regions, such as the medial prefrontal cortex and the right temporo-parietal junction. These findings highlight the need to take into account the critical roles played by an extensive network of neural regions during mental state reasoning. (shrink)

Ancient ethical theories, based on the notions of virtue and happiness, have struck many as an attractive alternative to modern theories. But we cannot find out whether this is true until we understand ancient ethics--and to do this we need to examine the basic structure of ancient ethical theory, not just the details of one or two theories. In this book, Annas brings together the results of a wide-ranging study of ancient ethical philosophy and presents it in a way that (...) is easily accessible to anyone with an interest in ancient or modern ethics. She examines the fundamental notions of happiness and virtue, the role of nature in ethical justification and the relation between concern for self and concern for others. Her careful examination of the ancient debates and arguments shows that many widespread assumptions about ancient ethics are quite mistaken. Ancient ethical theories are not egoistic, and do not depend for their acceptance on metaphysical theories of a teleological kind. Most centrally, they are recognizably theories of morality, and the ancient disputes about the place of virtue in happiness can be seen as akin to modern disputes about the demands of morality. Anna Puzio befasst sich in der ersten philosophischen Studie zur Anthropologie des Transhumanismus mit führenden Personen des Feldes, u. a. mit Nick Bostrom, David Pearce und Natasha Vita-More. Neben Körperoptimierung und Medizintechnologien beleuchtet sie auch Alltagstechnologien wie Wearables. This paper develops a largely neglected parallel between prudence and population ethics. Prudence is generally understood to be concerned with the balancing of well-being over time. How, precisely, well-being ought to be balanced over time, however, is a fervently debated question. I argue that developing a standard guiding such evaluations is exceedingly challenging. This is due to an often overlooked fact about prudence, namely that it shares a structural similarity with population ethics: In both contexts, we assess the comparative value (...) of populations of personstages/people, which may vary in number and level of well-being. Based on this analogy, I show that the development of an adequate theory of prudence runs into very similar impossibility results as obtain in population ethics. In particular, I prove that Arrhenius’ fifth impossibility theorem can be applied to prudence. I develop and compare four possible answers to this challenge. First, I discuss the possibility of accepting the very repugnant conclusion intrapersonally. Second, I present and further develop Donald Bruckner’s Minimax Regret approach, which gives up Transitivity. Third, I apply Jacob Nebel’s Lexical Threshold View to prudence and critically evaluate it. Lastly, I introduce what I call the Negative Lexicality View, which is based on Lexical Threshold View but overcomes some of its problems. (shrink)

The philosophical debate around the nature of moods has mostly focused on their apparent undirectedness: unlike mental states such as perceptual experiences, thoughts, and emotions, moods do not seem to be directed at any specific object, and indeed they do not seem to be directed at anything at all. In this paper, I want to draw attention to a different feature of moods, one that is as important and in need of explanation as their apparent undirectedness, but which has been (...) overlooked by most participants in the debate: the fact that moods involve a particularly marked salience of the subjective aspect of experience. I argue that any adequate theory of moods should account for this fact. I call this the “subjective salience desideratum.” In the bulk of the paper, I articulate and motivate the desideratum, show that extant theories of moods do not satisfy it, and offer a preliminary overview of possible (yet unexplored) theories that have the subjective salience desideratum at their core. On a common characterization, moral luck occurs when factors beyond agents’ control affect their moral responsibility. The existence of moral luck is widely contested, however. In this paper, I present a new challenge for deniers of moral luck. It seems that some factors beyond agents’ control—such as moral principles about blame- and praiseworthiness—clearly affect moral responsibility. Thus, moral luck deniers face a dialectical burden that has so far gone unnoticed. They must either point to a relevant difference between factors like (...) moral principles and the kind of factors that according to them do not affect moral responsibility or show how they can avoid having to point to such a difference. I argue that no obvious way to meet the challenge presents itself and that it thus amounts to a serious worry for deniers of moral luck. (shrink)

Our goal in this paper is to articulate a precise concept of at least a certain kind of disease-mongering, showing how pharmaceutical marketing can commercially exploit certain diseases when their best definition is given through the success of a treatment in a clinical trial. We distinguish two types of disease-mongering according to the way they exploit the definition of the trial population for marketing purposes. We argue that behind these two forms of disease-mongering there are two well-known problems in the (...) statistical methodology of clinical trials (the reference class problem and the distinction between statistical and clinical significance). The veil of ignorance has been used often as a tool for recommending what justice requires with respect to the distribution of wealth. We complete Harsanyi's model of the veil of ignorance by appending information permitting objective comparisons among persons. In order to do so, we introduce the concept of objective empathy. We show that the veil-of-ignorance conception of John Harsanyi, so completed, and Ronald Dworkin's, when modelled formally, recommend wealth allocations in conflict with the prominently espoused view that priority (...) should be given to the less able in wealth allocation. We finally argue that the veil of ignorance should be rejected as a tool for discovering what justice requires. (shrink)

Most recent philosophical theories of consciousness account for it in terms of representation, the bulk of the debate revolving around whether (suitably) representing something is sufficient for consciousness (as per first-order representationalism) or some further (meta-)representation is needed (as per higher-order representationalism and self-representationalism). In this paper, I explore an alternative theory of consciousness, one that aims to explain consciousness not in terms of representation but in terms of the epistemically and metaphysically direct relation of acquaintance. I call this the (...) Inner Acquaintance Theory of consciousness (IAT). Roughly, on IAT, what makes a mental state conscious is its subject being acquainted with it. Though not wholly unprecedented, IAT is still at the fringe of consciousness debates and remains largely underexplored. The main goal of this paper is to take some steps toward developing the details of IAT, illustrate its potential explanatory power, and put it forward as a plausible alternative to representational theories, with the hope that this will contribute to shifting IAT closer to the center of the debate. Here is how I proceed. In §2 I introduce a notion—inner awareness—that is crucial both to contextualize and to understand IAT. In §3 I provide some preliminary motivation for exploring IAT. In §4 I explain the notion of acquaintance and illustrate some of the features that are typically attributed to it in the literature. The details of IAT are then shaped through four main decision points. I address them in §§5-8, where I suggest a particular choice at each decision point, thereby progressively building up a view that I consider particularly promising. (shrink)

This paper explores the relationship between a prominent version of the relational view of memory and recent work on forms of unsuccessful remembering or memory errors. I argue that unsuccessful remembering poses an important challenge for the relational view. Unsuccessful remembering can be divided into two kinds: misremembering and confabulating. I discuss each of these cases in light of a recent relational account, according to which remembering is characterized by an experiential relation to past events, and I argue that experiential (...) relations do not adequately distinguish between remembering and unsuccessful remembering. This is because there are, on the one hand, cases of remembering that do not instantiate the relevant experiential relations, and, on the other hand, cases of confabulation and misremembering that do instantiate the relevant experiential relations. I conclude by suggesting that any successful relationalist attempt to explain remembering needs to come to grips with unsuccessful remembering. (shrink)
