The title of the following essay echoes one of Bobbio’s most famous books, and emphasizes one of its main issues: that of providing a “foundation” for the idea of rights. This essay summarizes what Bobbio means by “the age of rights” and presents his principal criticisms of any supposedly “absolute foundation” for rights. In exploring the notion of an age of rights without foundations Bobbio raised a number of crucial issues that effectively anticipated the contemporary debate around problems concerning the (...) historical transformation of rights and the origin of these rights in specific social processes, the deontological status of rights and the connection between rights and duties, the contrast between universalism and relativism, the relationship between different “generations of rights” and social rights, and the international protection of rights in relation to the idea of “institutional pacificism.” To pursue further reflection and enquiry along these lines would be a way of remaining faithful to the spirit of Bobbio’s teaching. But in order to do so it would also be necessary to question some of the methodological assumptions of Bobbio’s work: normativism in the area of jurisprudence, neopositivism in the field of epistemology, and the analytical approach in the history of ideas. This paper offers a critical analysis of two central issues in Luigi Ferrajoli’s Principia iuris , and more generally of his theory of rights. One is the way in which ‘expectations’ play a crucial role in his deontic theory by establishing the logical basis for his guarantee-based conception of law and rights. The axiomatic way in which Ferrajoli arrives at his conception of fundamental rights is questioned, for it fails to give a full account of the nature of subjective rights. (...) The other issues discussed here is Ferrajoli’s own defence of the universality of fundamental rights, and how this is made to depend on a ‘normative technique’ that one can associate with legal discourse and modern law in Western societies. This, however, poses the problem of how this formal universalism can be reconciled with the intercultural dialogue that Ferrajoli also advocates. (shrink)

We reexamine some of the classic problems connected with the use of cardinal utility functions in decision theory, and discuss Patrick Suppes's contributions to this field in light of a reinterpretation we propose for these problems. We analytically decompose the doctrine of ordinalism, which only accepts ordinal utility functions, and distinguish between several doctrines of cardinalism, depending on what components of ordinalism they specifically reject. We identify Suppes's doctrine with the major deviation from ordinalism that conceives of utility functions as (...) representing preference differences, while being non- etheless empirically related to choices. We highlight the originality, promises and limits of this choice-based cardinalism. (shrink)

Sets are central to mathematics and its foundations, but what are they? In this book Luca Incurvati provides a detailed examination of all the major conceptions of set and discusses their virtues and shortcomings, as well as introducing the fundamentals of the alternative set theories with which these conceptions are associated. He shows that the conceptual landscape includes not only the naïve and iterative conceptions but also the limitation of size conception, the definite conception, the stratified conception and the (...) graph conception. In addition, he presents a novel, minimalist account of the iterative conception which does not require the existence of a relation of metaphysical dependence between a set and its members. His book will be of interest to researchers and advanced students in logic and the philosophy of mathematics. (shrink)

I review recent work on Phenomenal Conservatism, the position introduced by Michael Huemer according to which if it seems that P to a subject S, in the absence of defeaters S has thereby some degree of justification for believing P.

In this paper, I argue against the popular philosophical thesis---aka the ‘own action condition’---that an agent can only intend one’s own actions. I argue that the own action condition does not hold for any executive attitude, intentions included. The proper object of intentions is propositional rather than agential (‘I intend that so-and-so be the case’ rather than ‘I intend to do such-and-such’). I show that, although there are some essential de se components in intending, they do not restrict the content (...) of intentions to one’s own actions. I then discuss the special way in which one’s own actions can figure in the content of one’s intentions, which shows that the distinction between intending and acting is less stark than it appears at first. This is a conclusion that many defenders of the own action condition might find appealing but which, I argue, is better supported by rejecting the own action condition. (shrink)

In this paper we focus on transmission and failure of transmission of warrant. We identify three individually necessary and jointly sufficient conditions for transmission of warrant, and we show that their satisfaction grounds a number of interesting epistemic phenomena that have not been sufficiently appreciated in the literature. We then scrutinise Wright’s analysis of transmission failure and improve on extant readings of it. Nonetheless, we present a Bayesian counterexample that shows that Wright’s analysis is partially incoherent with our analysis of (...) warrant transmission and prima facie defective. We conclude exploring three alternative lines of reply: developing a more satisfactory account of transmission failure, which we outline; dismissing the Bayesian counterexample by rejecting some of its assumptions; reinterpreting Wright’s analysis to make it immune to the counterexample. Phenomenal conservatism (PC) is the internalist view that non-inferential justification rests on appearances. PC’s advocates have recently argued that seemings are also required to explain inferential justification. The most general and developed view to this effect is Huemer (2016)’s theory of inferential seemings (ToIS). Moretti (2018) has shown that PC is affected by the problem of reflective awareness, which makes PC open to sceptical challenges. In this paper I argue that ToIS is afflicted by a version of the same problem (...) and it is thus hostage to inferential scepticism. I also suggest a possible response on behalf of ToIS’s advocates. This paper introduces the Monstrous Conclusion, according to which, for any population, there is a better population consisting of just one individual (the Monster). The Monstrous Conclusion is deeply counterintuitive. I defend a version of Prioritarianism as a particularly promising population axiology that does not imply the Monstrous Conclusion. According to this version of Prioritarianism, which I call Asymptotic Prioritarianism, there is diminishing marginal moral importance of individual welfare that can get close to, but never quite reach, some upper limit. (...) I argue that Asymptotic Prioritarianism faces a theoretical cost, that I call the Absolute Priority Principle. However, the Absolute Priority Principle is an extreme version of what I call the Trade-off Condition, an already noteworthy problem facing other (more widely endorsed) versions of Prioritarianism. I conclude that it is better for a theory to imply the Absolute Priority Principle and avoid the Monstrous Conclusion than to imply the Monstrous Conclusion and the Trade-off Condition. The potential for Asymptotic Prioritarianism is substantial. (shrink)

Crispin Wright maintains that the architecture of perceptual justification is such that we can acquire justification for our perceptual beliefs only if we have antecedent justification for ruling out any sceptical alternative. Wright contends that this principle doesn’t elicit scepticism, for we are non-evidentially entitled to accept the negation of any sceptical alternative. Sebastiano Moruzzi has challenged Wright’s contention by arguing that since our non-evidential entitlements don’t remove the epistemic risk of our perceptual beliefs, they don’t actually enable us to (...) acquire justification for these beliefs. In this paper I show that Wright’s responses to Moruzzi are ineffective and that Moruzzi’s argument is validated by probabilistic reasoning. I also suggest that Wright cannot answer Moruzzi’s challenge without weakening the support available for his conception of the architecture of perceptual justification. (shrink)

Crispin Wright’s entitlement theory holds that we have non-evidential justification for accepting propositions of a general type––which Wright calls “cornerstones”––that enables us to acquire justification for believing other propositions––those that we take to be true on the grounds of ordinary evidence. Entitlement theory is meant by Wright to deliver a forceful response to the sceptic who argues that we cannot justify ordinary beliefs. I initially focus on strategic entitlement, which is one of the types of entitlement that Wright has described (...) in more detail. I suggest that it is dubious that we are strategically entitled to accept cornerstones. After this, I focus on entitlement in general. I contend that, in important cases, non-evidential justification for accepting cornerstones cannot secure evidential justification for believing ordinary propositions. My argument rests on a probabilistic regimentation of the so-called “leaching problem”. (shrink)

In this chapter I shall address the question as to whether there exists a universal and atemporal justification for the claims made by a community that adopts a particular style of reasoning. I shall present a case study in which a claim made in the laboratory style of reasoning has no universal and atemporal justification. As I shall explain, Hacking justifies his belief that unobservable entities exist on the ground that they can be regularly manipulated by experimenters in order to (...) find out and produce various phenomena (experimental realism); he also maintains that no belief that our theories are true is required in order to be realist about unobservable entities. I shall argue that his justification is relative to the laboratory style of reasoning. Ultimately, from this case study I shall draw the important conclusion that the styles of reasoning project implies epistemic relativism. In the first part of this chapter, I shall analyse Hacking’s experimental realism in the light of the styles of reasoning project. I shall start by making these points: Hacking’s theory anti-realism denies the possibility of ranking styles of reasoning in terms of their capacity to explain phenomena; furthermore, Hacking is not successful in showing that his entity realism is justified for a community that does not adopt the laboratory style of reasoning. It will follow that the styles of reasoning project is in conflict with the claim that we know about unobservable entities. (shrink)

Supra-Bayesianism is the Bayesian response to learning the opinions of others. Probability pooling constitutes an alternative response. One natural question is whether there are cases where probability pooling gives the supra-Bayesian result. This has been called the problem of Bayes-compatibility for pooling functions. It is known that in a common prior setting, under standard assumptions, linear pooling cannot be nontrivially Bayes-compatible. We show by contrast that geometric pooling can be nontrivially Bayes-compatible. Indeed, we show that, under certain assumptions, geometric and (...) Bayes-compatible pooling are equivalent. Granting supra-Bayesianism its usual normative status, one upshot of our study is thus that, in a certain class of epistemic contexts, geometric pooling enjoys a normative advantage over linear pooling as a social learning mechanism. We discuss the philosophical ramifications of this advantage, which we show to be robust to variations in our statement of the Bayes-compatibility problem. (shrink)

I focus on a key argument for global external world scepticism resting on the underdetermination thesis: the argument according to which we cannot know any proposition about our physical environment because sense evidence for it equally justifies some sceptical alternative (e.g. the Cartesian demon conjecture). I contend that the underdetermination argument can go through only if the controversial thesis that conceivability is per se a source of evidence for metaphysical possibility is true. I also suggest a reason to doubt that (...) conceivability is per se a source of evidence for metaphysical possibility, and thus to doubt the underdetermination argument. (shrink)

Deflationists about truth hold that the function of the truth predicate is to enable us to make certain assertions we could not otherwise make. Pragmatists claim that the utility of negation lies in its role in registering incompatibility. The pragmatist insight about negation has been successfully incorporated into bilateral theories of content, which take the meaning of negation to be inferentially explained in terms of the speech act of rejection. We implement the deflationist insight in a bilateral theory by taking (...) the meaning of the truth predicate to be explained by its inferential relation to assertion. We combine this account of the meaning of the truth predicate with a new diagnosis of the Liar Paradox: its derivation requires the truth rules to preserve evidence, but these rules only preserve commitment. The result is a novel inferential deflationist theory of truth, which solves the Liar Paradox in a principled manner. We end by showing that our theory and simple extensions thereof have the resources to axiomatize the internal logic of several supervaluational hierarchies, including Cantini’s. This solves open problems of Halbach (2011) and Horsten (2011). (shrink)

A subject S's belief that Q is well-grounded if and only if it is based on a reason of S that gives S propositional justification for Q. Depending on the nature of S's reason, the process whereby S bases her belief that Q on it can vary. If S's reason is non-doxastic––like an experience that Q or a testimony that Q––S will need to form the belief that Q as a spontaneous and immediate response to that reason. If S's reason (...) is doxastic––like a belief that P––S will need to infer her belief that Q from it. The distinction between these two ways in which S's beliefs can be based on S's reasons is widely presupposed in current epistemology but––we argue in this paper––is not exhaustive. We give examples of quite ordinary situations in which a well-grounded belief of S appears to be based on S's reasons in neither of the ways described above. To accommodate these recalcitrant cases, we introduce the notion of enthymematic inference and defend the thesis that S can base a belief that Q on doxastic reasons P1, P2, …, Pn via inferring enthymematically Q from P1, P2, …, Pn. In this article, I claim that the treatise known as περὶ πνεύματος/De spiritu (481a-486b Bekker) was written by Theophrastus. My overall argument unfolds in three stages: first, I briefly summarize the arguments against De spiritu’s authenticity in Aristotle’s corpus. This summary will lead to my first argument which uses the very same reasons that prove the non-Aristotelian authorship to claim the Theophrastean one, in particular linguistic aspects of the text (§2). Next, I will focus on chronology, by discussing the mention (...) of one Aristogenes to show that Aristotle could not have known this individual (§3). Third and last, I will examine various aspects of the work that demonstrate stylistic and argumentative connections (§4), as well as doctrinal affinities with the works of Theophrastus, although some have attributed it to Strato (§5). On the basis of these arguments, I conclude that the weight of the evidence makes On Breath a work by Theophrastus (or his circle) rather than one composed by Aristotle. (shrink)

In Richard Bradley’s book, Decision Theory with a Human Face, we have selected two themes for discussion. The first is the Bolker-Jeffrey theory of decision, which the book uses throughout as a tool to reorganize the whole field of decision theory, and in particular to evaluate the extent to which expected utility theories may be normatively too demanding. The second theme is the redefinition strategy that can be used to defend EU theories against the Allais and Ellsberg paradoxes, a strategy (...) that the book by and large endorses, and even develops in an original way concerning the Ellsberg paradox. We argue that the BJ theory is too specific to fulfil Bradley’s foundational project and that the redefinition strategy fails in both the Allais and Ellsberg cases. Although we share Bradley’s conclusion that EU theories do not state universal rationality requirements, we reach it not by a comparison with BJ theory, but by a comparison with the non-EU theories that the paradoxes have heuristically suggested. Plant ethics is a field of philosophy that discusses the moral value of plants, and individual responsibilities toward them. As anthropogenic climate change is likely to have devastating effects on plants, a plant ethics analysis of climate change is crucial to fully understand the extent of people’s responsibilities toward plants. However, surprisingly little has been written on this topic. This chapter aims to provide an overview of the main positions in plant ethics as well as an initial exploration of the (...) following three salient questions concerning plant ethics and climate change. First, how stringent are people’s responsibilities to preserve plants? Second, do people have responsibilities to plant trees? Third, do people have responsibilities to help plant migration? Plant ethics theories struggle to different extent with each of these questions. On all theories, people have great responsibilities to preserve, if not individual plants, at least large forests, and on most theories people have some responsibility to help plant migration. On whether there are responsibilities to plant trees, different plant ethics theories deliver widely different results, from there being no responsibility to plant any tree to there being responsibility to plant as many trees as possible. All three questions are venues for future research in plant ethics. (shrink)

The Sure-Thing Principle famously appears in Savage’s axiomatization of Subjective Expected Utility. Yet Savage introduces it only as an informal, overarching dominance condition motivating his separability postulate P2 and his state-independence postulate P3. Once these axioms are introduced, by and large, he does not discuss the principle any more. In this note, we pick up the analysis of the Sure-Thing Principle where Savage left it. In particular, we show that each of P2 and P3 is equivalent to a dominance condition; (...) that they strengthen in different directions a common, basic dominance axiom; and that they can be explicitly combined in a unified dominance condition that is a candidate formal statement for the Sure-Thing Principle. Based on elementary proofs, our results shed light on some of the most fundamental properties of rational choice under uncertainty. In particular they imply, as corollaries, potential simplifications for Savage’s and the Anscombe- Aumann axiomatizations of Subjective Expected Utility. Most surprisingly perhaps, they reveal that in Savage’s axiomatization, P3 can be weakened to a natural strengthening of so-called Obvious Dominance. (shrink)

In this monograph we contrast two prominent models of education, Competence-Based Education (CBE), more recent and currently dominant in most school systems of the world, and Bildung-Oriented Education (BOE), once the basis of school systems of Northern Europe. CBE interprets learning as the acquisition of clearly definable and allegedly measurable competences, and is supported by supranational organisations, such as the OECD, which approach education from the perspective of the human capital theory. BOE instead characterises learning holistically as aimed at the (...) progressive articulation of a meaningful ‘big picture’ in the student’s mind. Emerged in Northern Europe under the influence of the ideals of the Enlightenment and Neo-Humanism of individual and collective autonomy and responsibility, BOE was subsequently enriched with a hermeneutical approach to teaching and socio-political objectives of emancipation and solidarity originating within Critical Theory. We argue that, in spite of its celebrated ‘scientificity’, CBE is internally incoherent and unreliable, contributes to structural forms of oppression and injustice, fosters social pathologies, and fails to provide students with the kind of intellectual autonomy they need as both human beings and citizens of our complex post-industrial societies. We also defend BOE from objections made by critical theorists, poststructuralists and postcolonial thinkers, and argue that it is a coherent and flexible model of education that endows students with autonomy and responsibility, and can help heal social pathologies. This paper reformulates the analogy between text and action in Paul Ricœur’s philosophy. My hypothesis is that such a reformulation better contextualizes the tensions in Ricœur’s practical philosophy, specifically between the social and the institutional. The aim is to show that Ricœur’s philosophy is tensional because it’s based on the principle of analogy. In order to think about this tension, we must grasp its true horizon: the analogy of text and action. After outlining this analogy’s genesis, we will see that (...) each of these terms—text, action, analogy—is determined by a “grammar of analogy,” which conditions all of Ricœur’s speeches and has its roots in his interpretation of intentionality. I examine the once popular claim according to which interpersonal comparisons of welfare are necessary for social choice. I side with current social choice theorists in emphasizing that, on a narrow construal, this necessity claim is refuted beyond appeal. However, I depart from the opinion presently prevailing in social choice theory in highlighting that on a broader construal, this claim proves not only compatible with, but even comforted by, the current state of the field. I submit that all in all, (...) the most accurate philosophical assessment consists not in flatly rejecting this necessity claim, but in accepting it in a suitably revised form. (shrink)

The representational theory of measurement has long been the central paradigm in the philosophy of measurement. Such is not the case anymore, partly under the influence of the critique according to which RTM offers too poor descriptions of the measurement procedures actually followed in science. This can be called the metrological critique of RTM. I claim that the critique is partly irrelevant. This is because, in general, RTM is not in the business of describing measurement procedures, be it in idealized (...) form. To support this claim, I present various cases where RTM can be said to investigate measurement without providing any measurement procedure. Such limit cases lead to a better understanding of the RTM project. They also illustrate some of the questions which the philosophy of measurement can explore, when it is ready to go beyond the metrological viewpoint. (shrink)

Despite a growing body of literature focused on understanding experiences of workplace dignity, attention has centered almost exclusively on employees with lower-level jobs. As a result, little is known about how workplace dignity and indignity are experienced by employees with middle- and upper-level jobs and how their experiences differ from those with lower-level jobs. We address these absences by interviewing employees from a diversity of lower-, middle-, and upper-level jobs about their experiences of indignity at work. We outline common dignity (...) threats, along with typical emotional responses and recourses employees use at each level. We find lower-level employees experience chronic dignity threats from being disrespected, devalued, demeaned, and dehumanized, to which their most typical response is endurance. Middle-level employees experience periodic dignity threats due to undermining of their work, confidence, and reputation. For them, the typical response is strategizing. Finally, on the rare occasions upper-level employees experience dignity threats, it usually is due to a disregard of their special expertise or denial of special rights, to which they respond by rising above. That space and time should be integrated into a single entity, spacetime, is the great insight of Einstein's special theory of relativity, and leads us to regard spacetime as a fundamental context in which to make sense of the world around us. But it is not the only one. Causality is equally important and at least as far as the special theory goes, it cannot be subsumed under a fundamentally geometrical form of explanation. In fact, the agent of propagation of (...) causal influence is electromagnetic radiation.
