In this roundtable discussion, early-career researchers working in the field of law, gender, and sexuality discuss international and trans-national developments to legal gender. ‘The Future of Legal Gender’ research project focused on the legislative framework of England and Wales to develop a prototype for decertification. The domestic legislation, however, was situated within a wider international context throughout the project. This roundtable discussion, therefore, provided an opportunity for reflection on the transnational issues raised by decertification, with a particular focus on developments (...) arising in the jurisdiction(s) studied by the early career researchers. The roundtable began with a brief outline of these recent developments before moving to an open discussion on key themes including the value of reform on wider society, changes on-the-ground by non-state actors, and alternative processes for tackling gender inequalities without certifying legal gender. Marcus William Hunt argues that prepositional gratitude to God is metaphysically impossible. This is because a fitting target of prepositional gratitude should be able to be benefited in return. Having the maximum well-being, God cannot be benefited in return and fails to be a fitting target. This view is debatable as some argue that God’s well-being can be increased in some peculiar sense. This paper proposes that Zhu Xi (1130-1200), a Confucian philosopher in China, can offer some plausible perspective. The (...) ultimate reality in Zhu, while perfectly good itself, can be in a better state of being when it has more manifestations (namely, when humans fulfill their moral nature.) This can serve as a parallel to suggest alternative conceptualizations of God and of his well-being, which always guarantee his maximum well-being in an intensive sense, while allow for an increase in his well-being in an extensive sense. In other words, we can uphold God as perfectly good per se while admit his having varying degrees of external well-being, which can account for his relationship with things, especially human beings, in the world. Shelley Weinberg argues that the idea of consciousness as a form of non-evaluative self-awareness helps solve some of the thorniest issues in Locke's philosophy: in his philosophical psychology, and his theories of knowledge, personal identity, and moral agency. The model of consciousness set forth here binds these key issues with a common thread.

This paper studies the relationship between organizational ethical climate and the forms of organizational citizenship behavior (OCB), including in-role and extra-role behaviors, and examines the mediating effect of employee loyalty. A sample of employees from a traditional Hong Kong-based company was used as a study group. The purpose of this study was to examine the causes and implications of how various ethical work climates affect employee performance. Based on a model proposed by Victor and Cullen, ethical climate is arranged from (...) lower levels to higher levels. The results suggest that lower levels of ethical climate (instrumentality and independence), characterizing a weak relational contract between employee and employer, are associated with negative extra-role behavior. In contrast, higher levels of ethical climate (caring and law-and-code), symbolic of a strong relational contract at work, are associated with positive extra-role behavior. Moreover, normative commitment mediated a positive relationship between caring and identification with the company, whereas attitudinal loyalty mediated the negative relationship between independence and altruism. ABSTRACTMerleau-Ponty’s Phenomenology of Perception begins with a critique of the philosophical notion of sensation. Even though it is often generally said to be aimed at traditional psychology or empiricism, Merleau-Ponty’s critique is without question also applicable to Husserl’s notion of sensation. The first half of this paper will offer an interpretation of Husserl’s conception of sensation as the stuff of perception and the pregivennesses for all of the Ego’s operations. And then it will attempt to show how Merleau-Ponty’s critique in (...) the Phenomenology of Perception can precisely be viewed as aiming at Husserl. In the end, we should be able to see that Merleau-Ponty’s critique is still relevant today, especially in regard to some recent attempts to put Husserl into the camp of non-representationalism in contemporary philosophy of mind. Patients who are subject to compulsory care constitute a substantial proportion of the work-load of mental health professionals, particularly psychiatric nurses. This article examines the traditional ‘beneficence-autonomy’ approach to ethics in compulsory psychiatric care and evaluates it against the reality of daily practice. Risk to the public has always been an important but often unacknowledged consideration. Inequalities exist among ethnic and socio-economic groups and there is a lack of agreement on what constitutes mental disorder. Two major changes in compulsory psychiatric (...) care - community orders and care for patients with untreatable severe personality disorders - further challenge the traditional ethical approach. There are also important human rights implications. The simple patient-health professional relationship no longer provides an adequate framework for mental health professionals on which to base their ethical decisions. The public and organizations may have different perspectives and their interests are becoming increasingly important. Mental health professionals, particularly psychiatric nurses, may face ethical dilemmas because of these different perspectives. (shrink)

This article offers a critical interpretation of Artificial Intelligence (AI) as a philosophical notion which exemplifies a secular conception of thinking. One way in which AI notably differs from the conventional understanding of “thinking” is that, according to AI, “intelligence” or “thinking” does not necessarily require “life” as a precondition: that it is possible to have “thinking without life.” Building on Charles Taylor’s critical account of secularity as well as Hubert Dreyfus’ influential critique of AI, this article offers a theological (...) analysis of AI’s “lifeless” picture of thinking in relation to the Augustinian conception of God as “Life itself.” Following this critical theological analysis, this article argues that AI’s notion of thinking promotes a societal privilege of certain rationalistic or calculative ways of thought over more existential or spiritual ways of thinking, and thereby fosters a secularization or de-spiritualization of thinking as an ethical human practice. According to the perspective developed in this article, widely shared, hegemonic cultural beliefs about gender and their impact in what the authors call “social relational” contexts are among the core components that maintain and change the gender system. When gender is salient in these ubiquitous contexts, cultural beliefs about gender function as part of the rules of the game, biasing the behaviors, performances, and evaluations of otherwise similar men and women in systematic ways that the authors specify. While the biasing (...) impact of gender beliefs may be small in any one instance, the consequences cumulate over individuals’ lives and result in substantially different outcomes for men and women. After describing this perspective, the authors show how it sheds newlight on some defining features of the gender system and illustrate its implications for research into specific questions about gender inequality. Legal interpreting and translation are some of the oldest and most frequently practised bilingual activities in Hong Kong. The principles and operation of the bilingual legal system actually impinge on the legal interpreting services and the practices of legal interpreting services also in ways impact on the system itself. This study adopts a historical approach to analyse the jurisprudence and administration of legal interpreting in Hong Kong courts from 1966 to 2016, across the 1997 dividing line between British colonial rule (...) and the return of Hong Kong to the government of mainland China. It focuses on the opinions of judges and other participants in courtroom proceedings as recorded in Hong Kong case reports. It is discovered that the jurisprudence of having an interpreter to interpret for participants who do not speak the language of the court is clearly indicated and well versed in the precedents. However, there is a gap between the jurisprudence and the actual interpreting services, mainly caused by the malpractices of the concerned administration department and some of the law enforcement agents working in the frontline. : This article critically examines the constitution of impairment in prenatal testing and screening practices and various discourses that surround these technologies. While technologies to test and screen prenatally are claimed to enhance women's capacity to be self-determining, make informed reproductive choices, and, in effect, wrest control of their bodies from a patriarchal medical establishment, I contend that this emerging relation between pregnant women and reproductive technologies is a new strategy of a form of power that began to emerge in (...) the late eighteenth century. Indeed, my argument is that the constitution of prenatal impairment, by and through these practices and procedures, is a widening form of modern government that increasingly limits the field of possible conduct in response to pregnancy. This article offers a reading of Sartre's phenomenological ontology in light of the pre-modern understanding of ‘transcendentals’ as universal properties and predicates of all determinate beings. Drawing on Sartre's transcendental account of nothingness in his early critique of Husserl as well as his discussion of ‘determination as negation’ in Being and Nothingness, this article argues that Sartre's universal predicate of ‘the not’ (le non) could be understood in a similar light to the medieval scholastic conception of transcendentals. But whereas the (...) scholastics saw the transcendental properties of oneness, truth, and goodness as reflections of God's divine perfections, Sartre's predicate of the ‘not’ operates as an atheistic transcendental which signifies the non-being of God – that God is not. By comparing Sartre's phenomenological ontology to medieval theological metaphysics, this article not only highlights the atheist underpinnings of Sartre's entire ontological schema in Being and Nothingness but also offers a new way of interpreting Sartre as a systematic transcendental metaphysician. While positive psychology has drawn increasing interests among researchers in the SLA literature recently, little is known with respect to the relationship between positive psychology and mental processes during L2 reading. To bridge the gap, the present study investigated whether and how positive psychology (self-efficacy) influences word reading strategies during L2 sentence reading. Based on previous studies, eye-movement patterns with first-fixation locations closer to the beginning of a word can be characterized as an attempt to process the word with a (...) local strategy, whereas first-fixation locations farther away from the beginning and closer to the center of a word can be considered as an attempt to use a global strategy. Eye movements of a group of Japanese learners of English (N = 59) were monitored, and L2 reading self-efficacy was used to assess the participants’ positive belief towards their L2 reading skills. Based on B. L. Fredrickson’s (1998) broaden-and-build theory, we predicted an effect of L2 reading self-efficacy on participants’ first-fixation locations. Results from mixed-effects regression showed that while reading strategies depended in part on other factors such as L2 reading proficiency and word properties, L2 self-efficacy influenced reading strategy. The present data suggest that while more self-efficacious L2 readers prefer a more efficient global strategy, attempting to read the word as a whole word, less self-efficacious L2 readers tend to employ a local strategy, focusing more on sublexical information. These findings lend support to the broaden-and-build theory in the context of L2 processing. The present study has implications for how positive psychology works along with L2 proficiency in the development of strategic selection during reading. (shrink)

This essay offers a reading of Badiou’s univocity of being in relation to his understanding of ontological immanence and also his commitment or indeed “fidelity” to ontologically articulating the atheistic premise that “God is dead”—which for Badiou also means “the One is not”. Although Badiou famously deploys set theory to develop his “univocal” mathematical ontology of the multiple in Being and Event, his most sustained and detailed discussion of the univocity of being is in his controversial critique of Deleuze’s ontology (...) in his Deleuze: The Clamor of Being. While references to (Badiou’s reading of) Deleuze will be made, it is not the purpose of this essay to add to the existing scholarship on the Deleuze-Badiou debate. Instead, the chief aim here is to apply Badiou’s accusations and criticisms of Deleuze’s univocal ontology back to Badiou’s own ontological project, and thereby consider how Badiou reconciles his “commitment to radical ontological univocity” with his metaphysical position against “the One” most vividly expressed in his critique of Deleuze’s univocal ontology. This article examines some of the recent theological critiques of the movement of technological human enhancement known as ‘transhumanism’. Drawing on the comparisons between grace and technology often found in the theological discourse on transhumanism, this article argues that the Thomistic distinction between healing grace and elevating grace can not only supplement the theological analysis of transhumanism and its ethical implications, but also help Christian theologians and ethicists become more aware of how the phenomenon of technology may have implicitly shaped (...) the contemporary understanding of ‘grace’ as well as the task of theology as a spiritual and indeed ethical practice. This article offers a reading of the “transcendental” character of Alain Badiou’s and Giorgio Agamben’s ontologies. While neither Badiou nor Agamben are “transcendental” philosophers in the Kantian sense, this article argues that their respective projects of ontology both recover aspects of the “classical” conception of the transcendentals. Not unlike how pre-modern philosophers conceived of oneness, truth and goodness as transcendental properties of all things, both Badiou’s and Agamben’s ontologies present various structures which can be universally predicated of all being. However, (...) as opposed to the essentialist or even theological tendencies of traditional metaphysics, Badiou’s and Agamben’s ontologies are committedly “inessential” and atheistic at their very core. By replacing the divine names of the one, the true and the good in traditional metaphysics with a new yet quasi-classical transcendental notion of “the void” as a universal predicate of all beings, Badiou’s and Agamben’s works may be regarded as projects that go beyond both the pre-Kantian “theological” and the post-Kantian “subjective” conceptions of transcendental philosophy, thereby marking a new development in the history of western metaphysics. This article offers a comparative reading of the ontologies of David Bentley Hart and Jean-Paul Sartre as well as their respective appeals to phenomenology as a philosophical method. While it may seem odd to compare one of the twentieth century’s most celebrated atheists with one of contemporary Christianity’s most highly-acclaimed critics of atheism, this article shows that there are many surprising parallels between the ontological outlooks of Hart and Sartre, namely their conceptions of God as the unity of being and (...) consciousness and their accounts of human consciousness as a desire to ‘become God’. By examining the similarities and differences between Sartre’s and Hart’s philosophical and theological works, this article seeks to highlight the phenomenological aspects of Hart’s theological outlook and consider how Hart’s appeal to the phenomenological analysis of intentional consciousness in his theological work can illuminate our understanding of the ongoing engagements between theology and phenomenology. Scholarly accounts of the training of pity in Jean-Jacques Rousseau's Emile focus on how Emile's tutor activates the psychological mechanisms necessary for the feeling of pity in book 4 of the text. This account is inadequate, for it fails to show how Emile acquires the evaluative ability to make the judgment about who deserves pity as well as the willingness to adjudicate his own and others' interests. In this article, Wing Sze Leung argues that books 1 through 3 lay (...) the foundation by developing in Emile the attitudes and dispositions that guide him in his judgment-making about which kind of life he should pursue. Books 4 and 5 then develop Emile's ability to make interpersonal judgments of pity through habituated practice. By gradually cultivating Emile's sensitivity to the potential conflict between his self-interests and others' well-being, as well as the resolution to refrain from infringing on others' interests and to pursue the common good, Rousseau's long-term educational project molds Emile's disposition to act as justice demands. The article concludes with a brief response to some criticisms about Rousseau's educational project. (shrink)

Arthur Danto argued from the premiss that artworks are essentially cognitive to the conclusion that they are incidentally aesthetic. I wonder why Danto, and the very many of us he persuaded, came to believe that the cognitive and the aesthetic oppose one another. I argue, contrary to Danto’s historical claims, that the cognitive and the aesthetic did not come into opposition until the late nineteenth or early twentieth century, and that they were brought into opposition for reasons of art-critical expediency (...) rather than philosophical necessity. I conclude that a robustly cognitive notion of the aesthetic remains an option for us. (shrink)

ABSTRACT In this article, I indicate how the naturalized and individualized conception of disability that prevails in philosophy informs the indifference of philosophers to the predictable COVID-19 tragedy that has unfolded in nursing homes, supported living centers, psychiatric institutions, and other institutions in which elders and younger disabled people are placed. I maintain that, insofar as feminist and other discourses represent these institutions as sites of care and love, they enact structural gaslighting. I argue, therefore, that philosophers must engage in (...) conceptual engineering with respect to how disability and these institutions are understood and represented. To substantiate my argument, I trace the sequence of catastrophic events that have occurred in nursing homes in Canada and in the Canadian province of Ontario in particular during the pandemic, tying these events to other past and current eugenic practices produced in the Canadian context. Since the enactment of the first Hong Kong bilingual ordinance in 1989, tremendous effort and resources have been put to translating English legal documents into Chinese. Long before the implementation of bilingual legislation, the provision of interpreting services has remained an entrenched practice in the courtrooms of Hong Kong. This study has adopted a corpora approach to re-examine what seems to be reasonable and routine practices of the bilingual, legal system, the impacts of bilingual legislation, translation, and interpretation on trial (...) proceedings. Results generated from the corpus show the problems of anglicized Chinese translation of the Sexual Offences Ordinance under the British Common Law system; and interpreters’ performance which is intricately bound by the discourse practices of the legal professionals as well as the ideology of the bilingual legal system in Hong Kong. Exploratory studies employing volunteer subjects are especially vulnerable to race and class bias. This article illustrates how inattention to race and class as critical dimensions in women's lives can produce biased research samples and lead to false conclusions. It analyzes the race and class background of 200 women who volunteered to participate in an in-depth study of Black and White professional, managerial, and administrative women. Despite a multiplicity of methods used to solicit subjects, White women raised in middle-class families who (...) worked in male-dominated occupations were the most likely to volunteer, and White women were more than twice as likely to respond to media solicitations or letters. To recruit most Black subjects and address their concerns about participation required more labor-intensive strategies involving personal contact. The article discusses reasons for differential volunteering and ways to integrate race and class into qualitative research on women. (shrink)

Aryeh Goldberg compellingly argues for a Narrative Coherence Standard (NCS) to bolster existing methods of assessing patients' mental capacity. But his account fails to distinguish between the cognitive abilities of children and adults; consequently, worries may be raised about the scope of the NCS, in particular when we consider child patients. In this article, I argue the NCS cannot plausibly apply to children. Since children's self-conception does not arrive fully formed — but rather is a product of both incomplete cognitive (...) development and socializing factors — I claim children may not possess a sufficiently intimate knowledge of self, and therefore a sufficiently coherent sense of self, as Goldberg demands. Therefore, we should either revise the NCS to accommodate children, adopt an incremental view of consent, or revert to the relevant form of the MacArthur competence criteria to establish children’s capacity to consent. Obstetric ultrasound is the well-recognized prenatal test used to visualize and determine the condition of a pregnant woman and her fetus. Apart from the clinical application, some businesses have started promoting the use of fetal ultrasound machines for nonmedical reasons. Non-medical fetal ultrasound (also known as ‘keepsake’ ultrasound) is defined as using ultrasound to view, take a picture, or determine the sex of a fetus without a medical indication. Notwithstanding the guidelines and warnings regarding ultrasound safety issued by governments and (...) professional bodies, the absence of scientifically proven physical harm to fetuses from this procedure seems to provide these businesses with grounds for rapid expansion. However, this argument is too simplistic because current epidemiological evidence is not synchronous with advancing ultrasound technology. As non-medical fetal ultrasound has aroused very significant public attention, a thorough ethical analysis of this topic is essential. Using a multifaceted approach, we analyse the ethical perspective of non-medical fetal ultrasound in terms of the expectant mother, the fetus and health professionals. After applying four major theories of ethics and principles (the precautionary principle; theories of consequentialism and impartiality; duty-based theory; and rights-based theories), we conclude that obstetric ultrasound practice is ethically justifiable only if the indication for its use is based on medical evidence. Non-medical fetal ultrasound can be considered ethically unjustifiable. Nevertheless, the ethical analysis of this issue is time dependent owing to rapid advancements in ultrasound technology and the safety issue. The role of health professionals in ensuring that obstetric ultrasound is an ethically justifiable practice is also discussed. (shrink)

Introduced into the philosophical lexicon during the Eighteenth Century, the term ‘aesthetic’ has come to be used to designate, among other things, a kind of object, a kind of judgment, a kind of attitude, a kind of experience, and a kind of value. For the most part, aesthetic theories have divided over questions particular to one or another of these designations: whether artworks are necessarily aesthetic objects; how to square the allegedly perceptual basis of aesthetic judgments with the fact that (...) we give reasons in support of them; how best to capture the elusive contrast between an aesthetic attitude and a practical one; whether to define aesthetic experience according to its phenomenological or representational content; how best to understand the relation between aesthetic value and aesthetic experience. But questions of more general nature have lately arisen, and these have tended to have a skeptical cast: whether any use of ‘aesthetic’ may be explicated without appeal to some other; whether agreement respecting any use is sufficient to ground meaningful theoretical agreement or disagreement; whether the term ultimately answers to any legitimate philosophical purpose that justifies its inclusion in the lexicon. The skepticism expressed by such general questions did not begin to take hold until the later part of the 20th century, and this fact prompts the question whether (a) the concept of the aesthetic is inherently problematic and it is only recently that we have managed to see that it is, or (b) the concept is fine and it is only recently that we have become muddled enough to imagine otherwise. Adjudicating between these possibilities requires a vantage from which to take in both early and late theorizing on aesthetic matters. (shrink)

The increased visibility of feminism in mainstream culture has recently been noted, with the presence of both online and offline campaigns embedding feminist claims in a variety of everyday spaces. By granting recognition to women’s experiences, these campaigns continue the feminist practice of generating critical knowledge on the basis of gendered experience. In the post-truth era, however, the norms governing claims-making are being significantly reconstructed, with significant consequences for critiques of gender inequality. It is argued here that these norms are (...) linked directly to a wider context of anti-feminism in which dismissing women’s claims is consistent with the goal that opponents of gender equality have of seeking and consolidating epistemic power in the face of what is perceived as systemic male disadvantage and victimhood. Returning to earlier debates within feminism, it is argued that the kinds of post-truth rhetoric used to dismiss women’s experience provide a challenge that feminism must confront. This rhetoric is often grounded in the authenticity of individual experience; however, experience cannot provide unmediated access to truth and, therefore, cannot provide the foundation for feminist claims. On the other hand, experience cannot merely offer one of many contested versions of ‘reality’. The excesses of both foundationalist and anti-foundationalist epistemology are countered with the argument that cognition is a human practice mediated by theoretical propositions which illuminate the question of what can be known. This is the role played by feminist theory in defending the role of experience. (shrink)

Spitale, Germani, and Biller-Andorno’s (2024) PHERCC matrix sets out a useful and systematic framework for risk and crisis communication in public health emergencies. A problem in ensuring effective messaging is the extent to which the messaging environment is *quiet* or *noisy*: in other words, whether or not a message has to *compete with other messages* at the same time. I use the example of the UK’s experience during COVID-19, which was marked by tensions between the devolved regional governments—and consequently divergent (...) policy responses—which sowed confusion among the populace. More generally, if policymakers try to account for the needs of competing publics simultaneously (in order to meet the inclusivity and understandability principles), this may increase the noise problem and so actually undermine effective public health messaging. Responsible research and innovation has come to represent a change in the relationship between science, technology and society. With origins in the democratisation of science, and the inclusion of ethical and societal aspects in research and development activities, RRI offers a means of integrating society and the research and innovation communities. In this article, we frame RRI activities through the lens of layers of science and technology governance as a means of characterising the context in which the RRI activity is (...) positioned and the goal of those actors promoting the RRI activities in shaping overall governance patterns. RRI began to emerge during a time of considerable deliberation about the societal and governance challenges around nanotechnology, in which stakeholders were looking for new ways of integrating notions of responsibility in nanotechnology research and development. For this reason, this article focuses on nanotechnology as the site for exploring the evolution and growth of RRI. (shrink)

Locke’s account of personal identity has been highly influential because of its emphasis on a psychological criterion. The same consciousness is required for being the same person. It is not so clear, however, exactly what Locke meant by ‘consciousness’ or by ‘having the same consciousness’. Interpretations vary: consciousness is seen as identical to memory, as identical to a first personal appropriation of mental states, and as identical to a first personal distinctive experience of the qualitative features of one’s own thinking. There is wide agreement, however, that Locke’s theory of personal identity is meant to complement his moral and theological commitments to a system of divine punishment and reward in an afterlife. But these commitments seem to require also a metaphysical criterion, and Locke is insistent that it cannot be substance. The difficulty reconciling the psychological and metaphysical requirements of the theory has led, at worst, to charges of incoherence and, at best, to a slew of interpretations, none of which is widely accepted. This paper raises two objections to the freedom of movement argument from the perspective of nonideal philosophy: the argument cannot provide a means for establishing admissions priorities when all prospective immigrants cannot be admitted and it ignores alternative grounds for moral claims to admission in the context of histories of injustice. I develop an alternative admissions-guiding principle that assigns strong moral claims to admission to certain prospective immigrants based on a global extension of the no-harm principle. It claims that a (...) society must admit prospective immigrants if admission is necessary either to prevent that society from harming those immigrants or to compensate immigrants whom it has already harmed. States must fulfill these duties before they may legitimately use immigrant admissions policy in service of other national goals, including the advancement of economic interests. (shrink)
